The purpose of a wrongful death lawsuit is to provide compensation to the surviving family members when the death of a loved one has been caused by the negligence or maliciousness of another person. Had the deceased survived the accident, they would be in a position to bring a lawsuit against the negligent party themselves, holding them accountable for their actions.
Due to the fact that the victim died, however, that same lawsuit is instead being filed by the surviving members of the family so that they are able to receive financial compensation for damages they have suffered such as outstanding hospital bills, emergency services, burial and funeral expenses, and pain and suffering.
